Booking Terms & Conditions for Pomegranate Cottage:
Proprietor: Mrs Hilary Roach
The following Booking Conditions forms the basis of any booking contract made with me. Please read them carefully, as they set out my respective rights and obligations. All bookings are made subject to these booking conditions being read and accepted by you.
Making your booking:
Bookings can be made either by post, telephone or e-mail. Once I have received your potential booking, subject to availability, a booking form will be sent to you. Once I have received your completed booking form and the booking deposit, your stay will be confirmed and confirmation will be issued either by post or by e-mail. Please check this carefully as soon as you receive it and contact me if any information appears on the confirmation to be incorrect or incomplete, as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracies in the confirmation details. It is important that we obtain your full details, as by law now, all guests staying in Hotels and other rented accommodation in Turkey must be registered with the authorities.
Payment:
In order to confirm your stay, a deposit of £100 for each full week’s holiday must be paid at the time of booking. This deposit is not refundable in the event of your cancellation or non-payment as listed below. The balance of the cost of your stay must be received by me at least 6 weeks prior to departure or sooner, (or the full amount should be paid at the time of booking if this is a late booking and that date has passed). The due payment date will be shown in the confirmation letter. If you have not paid in full and on time we reserve the right to treat your booking as cancelled by you. In this case the cancellation charges set out below in the Cancellation section, will be payable.
Security Deposit:
A security deposit of £100.00 should also be received by me with the balance of your booking fee. This fee is to cover the cost of any damage to the property or to any items in the property and any service charges incurred by you or any member of your party. These costs will be deducted by me from the security deposit at the end of your stay. If no deductions are required your security deposit will be refunded in full 7 days after your departure from the property. In the unlikely event that the security deposit is not sufficient to cover any damage caused by you, you will be responsible for paying me any additional monies required
I would be grateful if you could report any defects in the property and any equipment or appliance breakdowns, so arrangements can then be made for repairs or replacements to be made ready for the next guests.
Cost of your stay:
You must check the price of your stay at the time of booking, as errors can occur on websites or advertisements. The price of your stay will be confirmed at the time of booking, subject to the correction of errors.
Changes by you:
Should you wish to make any changes to your confirmed booking, you must notify us by telephone or email as soon as possible. Whilst we will try to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee may be payable together with any costs incurred by ourselves.
Cancellation by you:
Should you need to cancel your stay once it has been confirmed, the person who made the booking must immediately advise me in writing. Your notice of cancellation will only be effective when I have received it in writing and that I have also confirmed with you that I have received notification of the cancellation. As I may incur costs from the time that I confirm your booking and may be unable to re-sell your period of stay, the following cancellation charges will be payable.
Cancellation charges:
If the cancellation is made 8 weeks before the booking date – a charge of 25% of the booking fee will be made
If the cancellation is made 4 weeks before the booking date – a charge of 50% of the booking fees will be made
If the cancellation is made 2 weeks before the booking date – a charge of 75% of the booking fees will be made
Please note that as stated previously in the booking details, the deposit is non-refundable, therefore if the booking is cancelled by you, the deposit will not be refunded, however, the security deposit will be refunded in full.
Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of any insurance policy you may have. Claims must be made directly to the insurance company concerned.
Insurance:
Please note that there is no third party insurance on the property and therefore you are not covered by the owners’ insurance during your stay. The client is recommended to arrange adequate comprehensive travel holiday insurance to cover holiday cancellation, flights delays, including cover for personal belongings and emergency medical treatment. Also take note that, I the owner do not take any liability for personal injury loss or damage to personal property during the booking period. The use of the accommodation where offered, is entirely at the users risk and no responsibility can be accepted for any injury to a user or visitor and loss or damage to the user’s or visitor’s belongings. Under no circumstances shall the owners’ liability to the client exceed the amount paid to the owners for the agreed rental period. The owner of Pomegranate Cottage does not accept liability under any circumstances for death, personal injury, accidents, loss or damage of personal effects caused whilst residing at the Cottage.
Changes and Cancellation by the Owner:
In the extreme unlikely event where we have to make changes to or cancel confirmed bookings, whilst we always endeavour to avoid this we must reserve the right to do so. Very rarely, we may be forced by “force majeure” (see below) to change or terminate your stay after departure but before the scheduled end of your time away. This is extremely unlikely but if this situation does occur, we regret that we will be unable to make any refunds, pay you any compensation or meet any costs or expenses you incur as a result. We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”. In these Booking Conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control. Any losses or costs incurred through any of these unlikely events should be claimed through the guests travel insurance cover.
Rental Term:
The rental term is from the date of the departure flight and the date of the return flight. To allow for cleaning, the property may be occupied from 3pm on the first day of arrival and vacated at 11 am on the day of departure. However, if the property is not let immediately before and after your stay, you are more than welcome to arrive at any time and depart at any time at no extra charge.
Behaviour:
You accept responsibility for any damage or loss caused by you or any member of your party whilst you are staying in the cottage. Smoking is not permitted inside the Cottage or in the Chardak/Kosk. This is for the comfort of our other guests. Topless sunbathing (for women) is illegal in Turkey under Muslim law; therefore please respect this, so as not to offend local people.
Documents: Passports, Visa’s and Health Requirements:
It is your responsibility to ensure that you are in possession of all necessary travel and health documents, including Passports and Visas (where applicable) before departure. You must pay all costs incurred in obtaining such documentation. If you or any member of your party is not a British citizen or holds a non-British passport, you must check your passport and visa requirements before you travel to Turkey
Prices and Web site Accuracy:
Please note that the information and prices shown on the web site may have changed by the time you come to book your stay. Whilst every effort is made to ensure the accuracy of the web site and prices at the time of requesting the booking, regrettably errors do occasionally occur. You must therefore ensure you check all details of your stay (including the price) on your booking acceptance.
